Draft Policy on Rentals for Encroachments on Council Land

Council has recently adopted a draft policy on Rentals for Encroachments on Council land and wants your feedback on the policy before it is finalised.

What is the purpose of the draft policy?

The policy sets out how Council will charge a rental for the use of unformed roads and reserves where there is a private financial benefit being gained.

For example, where there is ongoing horticultural use of council land by an adjacent landowner - such as a commercial orchard. However, it will not apply to where the encroachment does not generate a private financial benefit – such as the extension of a residential garden onto a reserve.

There are two key parts of the policy:

1. The setting of market rental rates for different types of land use through Council’s annual Schedule of Fees and Charges.

2. Discounts to the market rates that may be applied. This will help reflect that some occupiers may not have exclusive use of the land (particularly on an unformed road) and recognise maintenance carried out on the land (which would otherwise be a cost to Council).
